1. Agreement to Terms

Welcome to DigiMail. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and DigiMail ("we," "us," or "our") governing your access to and use of the DigiMail mobile application and related services (collectively, the "Service").

By accessing, downloading, installing, or using DigiMail, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Important: These Terms contain provisions that limit our liability and require you to resolve disputes with us through binding arbitration on an individual basis, not in a class action.

2. Eligibility

You must be at least 13 years old to use DigiMail. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable law
• All information you provide is accurate and truthful
• You will comply with all applicable laws and regulations

If you are under 18 years old, you represent that you have obtained permission from your parent or legal guardian to use the Service.

3. Account Registration and Security

3.1 Account Creation

To use certain features of DigiMail, you must create an account by providing:

• A valid email address
• A unique username
• A secure password

Alternatively, you may register and sign in using Google OAuth authentication.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your account information remains accurate and up-to-date

We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violating these Terms or for any other reason at our sole discretion.

4. Service Description

DigiMail is a mobile application that enables users to:

• Scan and digitize physical mail, flyers, and coupons using their device camera
• Automatically categorize scanned documents using AI-powered vision models
• Organize scanned mail into 12 categories (Personal, Work, Bills, Advertisements, Newsletters, Financial, Promotions, Legal, Medical, Government, Educational, Other)
• Extract and manage coupon codes and expiration dates
• Extract event information and add it to device calendars
• Search, filter, and sort digitized mail
• Receive notifications about expiring coupons and upcoming events

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

5. User Content and Responsibilities

5.1 Your Content

You retain ownership of all content you upload to DigiMail, including scanned images and documents ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, process, and display your User Content
• Use AI models to analyze and categorize your User Content
• Back up and secure your User Content
• Provide the Service to you

This license terminates when you delete your User Content or account, except for content retained in backup systems (purged within 90 days).

5.2 Prohibited Content

You agree not to upload, scan, or submit content that:

• Is illegal, fraudulent, or violates any law or regulation
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is defamatory, obscene, pornographic, or offensive
• Violates privacy rights or contains personal information of others without consent
• Promotes violence, discrimination, or illegal activities
• Contains confidential or proprietary information you don't have rights to share

5.3 Content Monitoring

We do not pre-screen User Content, but we reserve the right to remove any content that violates these Terms or is otherwise objectionable, at our sole discretion.

6. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems, servers, or networks
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble the application
• Remove or modify any proprietary notices or labels
• Impersonate any person or entity
• Collect or harvest information about other users
• Circumvent any security features or rate limits
• Use the Service to send spam or unsolicited communications
• Upload excessively large files or abuse storage limits
• Attempt to exploit vulnerabilities for malicious purposes

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including its design, code, features, functionality, graphics, logos, and trademarks, is owned by DigiMail and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.

7.2 Third-Party Components

DigiMail uses open-source software and third-party services. These components remain the property of their respective owners and are used in accordance with their licenses.

8. AI-Powered Features and Limitations

8.1 AI Classification

DigiMail uses vision-language models (including Moondream and similar AI models) to automatically categorize and extract information from scanned mail. You acknowledge that:

• AI classification may not always be 100% accurate
• You are responsible for verifying the accuracy of categorized content
• We do not guarantee the accuracy, completeness, or reliability of AI-generated results
• Classification results are provided "as-is" without warranty

8.2 No Liability for AI Errors

We are not liable for any damages, losses, or consequences arising from incorrect AI classifications, missed coupons, incorrect event dates, or other AI-related errors.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using DigiMail, you consent to our data practices as described in the Privacy Policy.

10. Third-Party Services and Links

DigiMail integrates with third-party services including:

• Google OAuth for authentication
• Sentry for error tracking
• PostHog for analytics
• Device calendar applications
• Cloud hosting providers (Render.com, Modal.com)

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

11. Disclaimers and Warranties

11.1 AS-IS Basis

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties of uninterrupted or error-free operation
• Warranties regarding security or freedom from viruses

11.2 No Professional Advice

DigiMail does not provide:

• Legal, financial, or tax advice
• Medical or health-related advice
• Professional consulting services

You should consult appropriate professionals for advice specific to your situation.

11.3 Coupon and Event Information

We do not guarantee the validity, accuracy, or availability of coupons, promotions, or events extracted from your scanned mail. You are responsible for verifying all coupon codes, expiration dates, and event details.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGIMAIL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or errors
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party
• AI classification errors or missed information
• Expired or invalid coupons
• Any other matter relating to the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless DigiMail and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content
• Your violation of any applicable laws or regulations

14. Dispute Resolution and Arbitration

14.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@digimail.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

14.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

14.3 Exceptions

Either party may seek injunctive or equitable relief in court to protect intellectual property rights.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in California.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the app
• Updating the "Last Updated" date
• Sending an email notification (if applicable)

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

17. Termination

17.1 Termination by You

You may terminate your account at any time by contacting us at support@digimail.app. Upon termination:

• Your account and User Content will be deleted within 30 days
• You will lose access to all Service features
• Backup data will be purged within 90 days

17.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, for:

• Violation of these Terms
• Illegal or fraudulent activity
• Abuse of the Service or other users
• Non-payment (if applicable)
• Any other reason at our sole discretion

17.3 Effect of Termination

Upon termination, all licenses granted to you will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including but not limited to disclaimers, limitations of liability, and dispute resolution provisions.

18. General Provisions

18.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and DigiMail regarding the Service.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.

18.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, natural disasters, or failures of third-party services.

18.6 Export Compliance

You agree to comply with all applicable export and import laws and regulations in your use of the Service.

18.7 Mobile Device Requirements

Use of DigiMail requires a compatible mobile device and operating system. You are responsible for:

• Providing and maintaining compatible devices
• Internet connectivity and data charges
• Device updates and compatibility
• Sufficient storage space
